Judges from across the state engage in a dynamic discussion of the procedural status of the courts and adjustments being made in order to address peculiar problems presented by the pandemic. Labor Code and Leave Claims in the COVID-19 Era

Date Published: October 15, 2020

Summary

The COVID-19 pandemic fundamentally altered the California workplace, with employees facing mass layoffs, being required to work in unsafe conditions, and being required to work from home. This panel addresses the provisions of the Labor Code and leave laws that employees can use to address COVID-19 issues. Topics include: enforcing the health and safety provisions of the Labor Code through PAGA actions; the Labor Code provisions that protect employees who complain about health and safety issues from retaliation; wage-and-hour issues faced by employees working from home, including the failure to reimburse business expenses; WARN Act and timely payment issues faced by laid-off employees; and the patchwork of federal, state and local leave laws available to employees. Panelists help attendees understand how to issue spot and discuss the most common wage-and-hour issues that they are facing in their own practices.
