Summary

This is part of a series on How To Talk About Race At Trial co-sponsored by Immigrant Employee Rights and Racial Justice Committees.

Part 3: After hearing witnesses and seeing evidence about non obvious racial discrimination, systemic racism at work, and microaggressions, how does the lawyer tie it together to educate the jury that these are illegal forms of racism? This webinar attempts to guide participants on strategies to empower jurors and judges in closing arguments at trial to identify in the evidence socially prevalent forms of racism and microaggressions as discrimination and asses the harm that it caused the BIPOC worker. This panel will also discuss how to craft verdict forms for race discrimination cases to guide jurors to find the appropriate damages for the aggrieved worker and anticipate typical defense arguments that minimize the harm to workers who experienced non obvious forms of racism and discrimination.
