Summary

Experienced trial and appellate practitioners detail underutilized arguments for defeating motions to compel arbitration and for appealing orders compelling arbitration. The panel will cover often overlooked issues, including key strategy considerations, delegation clause attacks, the transportation worker exemption, formation attacks, and promising new arguments for procedural and substantive unconscionability. The presentation will also cover how to leverage Cook v. USC after Ayala-Ventura v. Superior Court, and how to respond to preemption arguments under Sandler v. Modernizing Med., Inc.
