This panel will assist litigators in defeating arbitration agreements from initial intake through the evidentiary hearing on the motion to compel.  Attendees will learn about emerging issues in arbitration jurisprudence, including the evidentiary threshold for challenging electronic signatures, the transportation worker exemption under recent Supreme Court cases, the preemption landscape surrounding Labor Code § 229 and § 432.6, and cases that the California Supreme Court is slated to hear in 2026.  The panelists will cover the latest developments under the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act (EFAA), and creative arguments for invoking it in FEHA cases.  The presenters will equip attendees with practical advice for navigating evidentiary proceedings on arbitration motions, evidentiary burdens, objections, and the importance of statements of decision.  It will conclude with a demonstration on how to examine a plaintiff during the evidentiary hearing on a motion to compel arbitration and cross-examine the employer's witness.
